Terms of Purchase

These terms of purchase (together with any information and policies referred to in these Terms) ('Terms') set out the legal terms that apply to the purchase of products on our website rinskin.com and any other websites or apps operated by us or on our behalf (together, the 'Websites' and 'Website' being a reference to any one of them) or any other products that we provide (the 'RIN Products').

Please read these Terms carefully and make sure that you understand them. Please note that by placing an order or signing up for a subscription for any RIN Products, you agree to be bound by these Terms. If you do not indicate your acceptance of these Terms, you will not be able to purchase RIN Products.

1. Understanding these Terms

1.1 When we refer to 'we', 'us' or 'our', we mean Rin Lab Ltd and we operate the Website. Where we refer to 'you' or 'your' we mean you, the person purchasing the RIN Products. We are a company registered in England and Wales (company number 16944047) with our address is at 66 Paul Street, London, England, EC2A 4NA. Our VAT number is 514200548.

1.2 We have used headings to help you understand these Terms and to easily locate information. These Terms are only available in the English language.

2. Where to find information about us and our products

You can find everything you need to know about us, Rin Lab Ltd, and the RIN Products on our Website before you order.

3. Our RIN Products

3.1 Currently, you may only purchase RIN Products through the Website, either by signing up to a subscription (a 'Subscription') or through the purchase of individual RIN Products.

3.2 In order to purchase RIN Products, you must:

hold a valid debit or credit card issued by a bank that is acceptable to us, or a PayPal or Apple Pay account; and
provide your personal and payment details, including your full name, phone number, email address, postal address and any other requested information. For more information about how we use your personal information please refer to our Privacy Notice; and
be over 18 years of age.

3.3 By placing an order, you are promising that all details you provide are true and accurate, that you are over 18 years of age, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds in the account to cover the cost of your order.

4. Your order

4.1 Placing your order

By completing the check-out process and placing an order, you are making an offer to purchase RIN Products in accordance with these Terms. A binding contract will only be formed between you and us once we have confirmed that we have accepted your order and we may refuse to accept any order placed for any reason, without liability.
Risk in any RIN Products that you order will pass to you when they are delivered to the delivery address specified by you when you placed your order.
At the time when your order is placed, your chosen payment method will be charged in the amount equivalent to the total price for the RIN Products that are the subject of the order. The transaction may appear as 'pending' on your bank statement until your order is fulfilled. In the event that we encounter a problem when processing your order, we will contact you and may possibly request further information to try and resolve the issue.
The Website allows you to check your order and correct any errors before completing a purchase for RIN Products. Please take the time to read and check your order at each page of the order process as you are responsible for ensuring that the information you provide is accurate (for example, the correct products, quantities, etc).
We will also provide you with an e-mail confirming the details of your order and details of delivery (eg delivery address and delivery date(s)) or your Subscription details, as applicable. Please note that when we send you this order confirmation e-mail, we are accepting your offer and a contract is formed between you and us at this stage.
Sometimes we reject orders, for example, because a product is unexpectedly out of stock, or because the product was mispriced by us. When this happens, we will let you know as soon as possible. We also reserve the right to restrict or limit the quantity of particular RIN Products being shipped to any one customer or postal address.

4.2 Product prices

The prices on the Website are inclusive of VAT and displayed in pounds sterling (GBP). Delivery costs are not included in the prices and will be charged in addition. The delivery costs (which will include VAT charged by us) will vary depending on the RIN Products that you have ordered, your delivery address and the type of delivery you select. The delivery costs applicable to your order will be clearly displayed at checkout before you place your order.
We use Shopify International Limited (or its affiliates) ('Shopify') to provide payment processing services on our Website. When you make a payment, your payment details will be processed by Shopify in accordance with its privacy policies here.
You may be required to accept Shopify's terms in order to complete a payment. These terms govern the provision of payment services and are separate from these Terms.
From time to time, we may make promotions, discounts or other special offers available in respect of RIN Products. We may amend, suspend or withdraw any such promotion, discount or special offer at any time. However, where you have placed an order or entered into a Subscription in reliance on a promotion, discount or special offer before it is withdrawn, we will honour that promotion, discount or special offer in respect of that order or Subscription.
Nothing in these Terms affects your legal rights as a consumer including our obligations to you in relation to the supply of the RIN Products or any refund or cancellation rights you have under UK consumer law.

4.3 Delivery

The estimated delivery date(s) of the RIN Products whether purchased individually or by Subscription will be stated in your order confirmation email, and, if purchasing through a Subscription, each subsequent confirmation email. We use Royal Mail tracked delivery to send orders so if you do not receive an estimated delivery date from us, your order should within 48 hours from the date of dispatch from our warehouse, which is the estimated time provided by Royal Mail. We will try to ensure that your order is delivered by the estimated delivery date if given, but there may be circumstances where delivery is delayed because of events beyond the reasonable control of our agents, suppliers or ourselves (please see section 8.4 below for further information). If this happens, we will try and arrange for your RIN Products to be delivered as soon as possible, but we will not be liable to you for any losses caused as a result of such delay.
If we become aware that supply of your RIN Products is delayed by an event outside our control, we contact you as soon as possible to let you know and do what we can to reduce the delay. We may not be able to compensate you for the delay in these circumstances, but if the delay is likely to be substantial, you can contact us at hello@rinskin.com. In some cases, you may be able to cancel the order and receive a refund for the RIN Products you have paid for but not received.

4.4 Use of RIN Products

The RIN Products must always be used in accordance with the instructions and warnings provided. We do not guarantee that use of the RIN Products will achieve any particular results (which may vary depending on factors such as age, skin type, lifestyle and consistency of use). Any testimonials or reviews we provide are based on users' own experiences which may not be the same for everyone.
Any product images appearing on our Website are provided for illustrative purposes only, however the RIN Products you receive may not exactly match the image shown on your device and its presentation or packaging may be slightly different. However, as a consumer, you have legal rights in relation to RIN Products that are faulty or materially not as described.
The RIN Products available on this Website are supplied only for personal consumption by individual consumers in the UK and any resale or other use is strictly prohibited. We have no responsibility in connection with any demands, claims, losses, liabilities or other expenses arising from any RIN Products being purchased, used or sold by someone who is not acting as a consumer or being used by customers outside the UK.

4.5 We can change RIN Products and these Terms

We can always change the RIN Products:
1. to reflect changes in relevant laws and regulatory requirements; and
2. to make minor technical adjustments and improvements. These are changes that don't materially affect your use of the RIN Products.
We can withdraw certain RIN Products available for sale at any time. If you have ordered RIN Products that are being withdrawn on Subscription, we will notify you in writing in advance of the renewal of your Subscription.

5. Subscriptions

5.1 To the extent that you are ordering RIN Products on Subscription, this section 5 shall apply.

5.2 We offer a Subscription for our RIN Products on both four week and twelve week terms. When you order RIN Products on Subscription, you will be charged for the initial Subscription at the time that your order is confirmed in accordance with section 4.1(e) and the contract between us is formed.

5.3 Your Subscription to our RIN Products includes enrolment into an ongoing four-weekly or twelve-weekly payment plan, depending on the Subscription term you choose. Every four or twelve weeks thereafter, unless your Subscription is amended or cancelled, you will be charged for the RIN Products on the date that is four or twelve weeks from your Subscription date (or nearest possible date). Payment will be charged to the payment method you selected when you placed your order initially (or such other payment method as you notify to us).

5.4 Your Subscription will automatically renew every four or twelve weeks and you will receive recurring deliveries on a four or twelve week basis. You can cancel or amend your Subscription at any time by filling in the online form at Appendix 1 hereto and returning it to us, or through your online account. To ensure that your next payment and shipment are not processed, you must cancel your Subscription before the applicable cancellation or amendment cut-off date which is [28 days] before your next scheduled billing date.

5.5 If you cancel your Subscription in accordance with section 5.4, your Subscription will terminate at the end of the current billing period, and no further charges will be made. If you cancel your Subscription after the applicable cancellation cut-off date, your cancellation will take effect at the end of the following billing period, and you will be charged for, and receive, the next scheduled delivery.

5.6 Each time your Subscription renews, we will send you an email confirming the renewal of your Subscription. The email will be sent to the email address provided when you placed your initial order (or any updated email address you have subsequently notified to us) and will include details of the upcoming delivery, confirmation that your Subscription remains active, information about your right to cancel, and instructions on how you can do so. Where applicable law requires us to provide reminder notices or additional information in connection with your Subscription, we will include such information in the renewal confirmation email, the renewal reminder email or provide it separately as required by law.

5.7 Cancellation of your Subscription will prevent future charges and deliveries but will not already affect any RIN Products already dispatched. For your rights to return any RIN Products dispatched, please see section 6 below.

5.8 We reserve the right to change the pricing of our RIN Products that are available by Subscription. In the event of such a change in price, we will notify you no less than one month in advance of the change using the e-mail address you provided when placing the initial order, unless you have notified us of a change in your e-mail address. If you do not wish to accept a price change, you may cancel your Subscription by telling us before the date of the price change taking effect in line with section 5.4.

5.9 If you do not cancel your Subscription in line with section 5.4, we will presume that you accept the price change and your Subscription will automatically renew with the new price.

6. Returns and refunds

6.1 Cancellation rights

You have a statutory right to cancel your order up to 14 days following:
1. in the case of any one-off purchase of RIN Products, delivery of the RIN Products to you or a third party nominated by you;
2. in the case of a Subscription, the first delivery of the RIN Products to you or a third party nominated by you.
To exercise your right to cancel, you must inform us of your decision to cancel by filling in and returning the form at Appendix 1 hereto, or through your online account.

6.2 Exclusion of cancellation rights - sealed RIN Products

Our RIN Products may be supplied as multi-unit packs, and each individual unit is sealed for health protection and hygiene purposes.

Where RIN Products are in a sealed package for health protection or hygiene purposes, your right to cancel set out in section 6.1 ceases immediately where any such RIN Product is unsealed.
Nothing in this section prevents you from opening the outer packaging and inspecting the product to the extent necessary to establish its nature, characteristics and functioning, provided that individual sealed units are not opened.

6.3 Faulty or misdescribed RIN Products

Nothing in these Terms affects your legal rights as a consumer under applicable law in respect of RIN Products which are faulty, not as described, or not of satisfactory quality.
If you think there is something wrong with your product, you must contact our customer service team at hello@rinskin.com. We acknowledge our duty to provide you with products that are as described and that comply with applicable legal requirements.
Your legal rights are summarised below. These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.citizensadvice.org.uk.

6.4 Returning RIN Products

Unless you are returning RIN Products in line with your cancellation right in section 6.3 above, you are responsible for the cost of returning RIN Products. You can return RIN Products to the following address Rin Lab Ltd / Fulfillable Limited, Dettingen Way, Bury St Edmunds, IP33 3YB using an established delivery service. You should keep a receipt or other evidence from the delivery service that proves you have sent it and when you sent it.
You must send back the RIN Products back to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation to us.

6.5 Refunds

If you are entitled to a refund, we will refund you the cost of the individual order you are returning (whether it is an individual order or one delivery of a Subscription), together with standard postage you paid.
We will subtract the following amounts from your refund, where applicable:
1. RIN Products that are not eligible for refund, discussed at section 6.2 above. We will deduct what you paid for any non-returnable RIN Products supplied during the relevant cancellation period;
2. returnable RIN Products that have not been returned. We deduct what you paid for any returnable RIN Products supplied during the relevant cancellation period which you do not return to us, plus all delivery costs for these;
3. any enhanced delivery costs. We will not refund any additional sums paid for enhanced delivery options, such as fast or named day delivery;
4. returned RIN Products that you have used or damaged. We reduce your refund to reflect any loss in value if returned RIN Products are not in 'as new' condition. For example, this may apply if the item has been used, branded packaging is damaged or individual packaging has been opened.

7. Our liability to you in relation to the RIN Products

7.1 If, in providing the RIN Products, we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a directly foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you started using the RIN Products. We do not in any way exclude or limit our liability for:

death or personal injury caused by our negligence;
our fraud; or
any other liability which we cannot limit or exclude under applicable law.

8. Other important information

8.1 Severability

Each section and paragraph of these Terms operates separately. If any court or relevant regulatory authority decides that any of them are unlawful or unenforceable, the remaining sections and clauses will remain in full force and effect as far as possible.

8.2 Waiver

If you breach these Terms and we take no action, or if we delay in taking action, that does not mean that we have waived our rights and we will still be entitled to use our rights and remedies. If we do waive a breach by you, we will only do so in writing, and that will not mean that we will automatically waive any later breach by you.

8.3 Entire agreement

These Terms constitute the entire agreement between you and us and they supersede any and all earlier agreements between you and us.

8.4 Events outside of our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations to you if such failure or delay is caused by an event outside of our control. An event outside of our control means any act or event beyond our reasonable control the effects of which we could not have reasonably avoided such as act(s) of God, wars, terrorist attacks, embargos, riots, strikes, lock-outs, trade disputes, fires, floods, earthquakes or other natural disasters, break-down, inclement weather, interruption of transport, a pandemic or other health emergency, emergency Government action or failure of public or private telecommunications or transport networks. If such an event takes place and it affects the performance of our obligations to you:

we will notify you as soon as reasonably possible; and
our obligations to you will be suspended for the duration of the event. Where the event affects delivery, we will contact you to arrange a new delivery date after the event is over.

8.5 Complaints

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments. Please see our 'Contact Us' page for details of how to get in touch with us.

9. Governing law and jurisdiction

Anything related to your order or these Terms is governed by English law. To the fullest extent permitted by law, the courts of England shall have the exclusive jurisdiction over any dispute or claim relating to these Terms. The above however does not affect any mandatory legal rights you may have as a consumer to take legal action in the country or territory where you live, including (without limit) your right to take action in the Scottish courts (if you live in Scotland) or in the courts of Northern Ireland (if you live in Northern Ireland).
